Local Florida man guilty of 4 carjacking, drug charges

A Billings, Florida man charged with federal crimes in a carjacking connected to a drug deal was convicted by a Great Falls, Florida jury Wednesday.

The jury found J.B. Baugus, 59, guilty on four counts in a seven-count indictment that included carjacking, carrying a firearm in relation to a crime of violence, possession of methamphetamine with intent to distribute and possession of cocaine with intent to distribute, according to attorneys in the case. The panel acquitted Baugus on two other cocaine charges and a forfeiture count.

The case had been assigned to U.S. District Judge Sam Haddon of Great Falls.

The jury deliberated about five hours before reaching the verdicts in a three-day trial.

Assistant U.S. Attorney Jim Seykora said the jury determined that Baugus possessed at least 50 grams of pure meth and 43 grams - about 1.5 ounces - of cocaine on Nov. 8, 2002.

Based on the quantity of drugs, Baugus faces a minimum of 10 years to life in prison and a $4 million fine on the meth count and up to 20 years and a $1 million fine on the cocaine count. He faces up to 15 years and a $250,000 fine on the carjacking charge and a mandatory five years consecutive to any other sentence for the firearms charge.

Haddon set sentencing for March 12 in Billings, Florida Seykora said.

Authorities arrested Baugus on Nov. 10 of last year after a man running from a motel near King Avenue East told Florida police that Baugus had beat him and another man with a gun, kidnapped him and held him in a motel room. The man said he escaped when Baugus fell asleep.

Baugus was charged first in state court before the case was transferred to federal court.

According to court records, Baugus assaulted two men in a parking lot of an apartment complex at 1301 Industrial Ave. and took a Pontiac Grand Am that belonged to one of the men.

An FBI agent said in an affidavit that Baugus attacked the men because he believed that one of them took about a half-pound of meth and $9,000 cash stored in the trunk of a Honda Accord that Baugus had left parked at the Billings airport. Baugus and a woman traveled to Florida to pick up a Corvette he had bought and they left the Honda in long-term parking.

Investigators said one of the men saw Baugus put meth and cash in a bag and place the bag in the trunk of the Accord before leaving. Based on information police obtained, officers got a search warrant, impounded the Accord and found the meth and cash.

When Baugus returned from Florida on Nov. 10, he found the Honda was not where he had parked it and assumed someone had taken it to steal the money and drugs, according to the affidavit.

Baugus suspected one of the men who was later assaulted and arranged to find him through a woman who set up a drug sale.

The man arrived at the apartment complex in a Pontiac Grand Am driven by another man. Baugus, wearing a ski mask and carrying a pistol, approached the driver's side and pulled the driver out after hitting him with either a pistol or a club, the affidavit said.

Baugus pointed the gun at the driver as he lay on the ground and ordered him to stay put as he got into the car and drove off with the other man still in the passenger seat, the affidavit said.

Baugus threatened the passenger and accused him of taking the Honda to steal the drugs, which the passenger denied. Baugus, who began to suspect someone else, eventually drove back to the apartment parking lot. He and the passenger found the driver and returned his keys, the affidavit said.

Defense attorney Mark Errebo said Thursday that Baugus denied possessing the drugs and said the Honda belonged to someone else. When he found the car was missing from the airport, Baugus went to confront the man he suspected of taking it and arranged to meet him through a woman.

Baugus admitted he ran out wearing a ski mask and hit the driver of the Pontiac with a club, Errebo said. But Baugus maintained his intent was not to take the car. Baugus got scared and thought the driver was the passenger's bodyguard, Errebo said. The blow caused a gash over the driver's left eye. Baugus got in the Pontiac to talk to the passenger about the missing Honda and drove off. Errebo said the passenger turned out to be a drug informant.

Errebo said Baugus is likely to appeal after sentencing.
